While the terminology is a little odd, most likely the forward path is your downstream or rx, while return path is your upstream or tx.

Based on everything I've gathered and read, an rx of 40.9 is well out of spec and your modem probably wouldn't work at all, which makes me think that is the tx level.

This also serves an additional anecdotal evidence that my -14 rx is a sign that things are jacked up.
